Korea Zinc filed a complaint with the Financial Supervisory Service, saying that MBK Partners violated confidentiality contracts and used data provided for the purpose of reviewing new investments in the company in the past to receive its management rights.
Korea Zinc announced on the 15th that it has submitted a petition to the Financial Supervisory Service, saying, “We need to investigate and inspect MBK’s alleged violation of the NDA.”
Korea Zinc claimed in the past that MBK received 112 pages of undisclosed consulting materials from Korea Zinc that forecast troika drive strategy and Korea Zinc’s corporate value and used the information for hostile M&As.
Earlier, MBK received data on “Troika Drive” from Korea Zinc two years ago when it was considering a new investment in Korea Zinc, but it did not ultimately proceed with the investment.
The NDA signed by MBK and Korea Zinc in this regard ended in May.
Korea Zinc has recently publicly accused MBK of attempting aggressive mergers and acquisitions with the company using its internal data provided for investment review at the time.
